ARTWORK SALES TERMS & CONDITIONS •Effective February 25, 2026 •Lily Fertik, doing business as Lily Life Designs (“Artist,” “Company,” “Seller”), operates this website and all related sales channels. •By sending payment of any amount, the Buyer affirms that they have read, understood, and accepted these Terms & Conditions in their entirety. Submission of payment constitutes binding contractual acceptance. Failure to read these Terms does not invalidate acceptance. If you do not agree, do not proceed with purchase. IMPORTANT PURCHASE DISCLOSURE •Shipping is NOT included in the listed artwork price. •Buyer is solely responsible for all shipping, handling, insurance, customs duties, taxes, and related expenses. •Artwork is considered SOLD upon confirmation of payment. •Risk transfers immediately upon delivery to the shipping carrier. •All sales are FINAL. No refunds. No returns. PRICING, SHIPPING & DELIVERY •The listed price covers the artwork only. •Shipping, handling, insurance, customs duties, taxes, and all related costs are the sole responsibility of the Buyer. •Buyer is solely responsible for selecting the shipping carrier and service level, including full insurance coverage appropriate for fine artwork. •The Artist may provide recommendations, but final selection and contractual relationship with the carrier rest exclusively with the Buyer. TRANSFER OF RISK Ownership and all risk of loss, theft, delay, or damage transfer to the Buyer immediately upon delivery of the artwork to the selected shipping carrier. The Artist bears no responsibility for shipping-related damage or loss. All claims must be filed directly with the carrier. PAYMENT •All purchases must be paid in full via Venmo unless expressly approved in writing. •Orders are not confirmed until payment is successfully received. •Buyer is solely responsible for ensuring payment is sent to the correct Venmo account. •Once payment is submitted, the sale is final and may not be canceled. NO RETURNS. NO REFUNDS. ALL SALES FINAL. •No refunds, returns, exchanges, credits, or cancellations will be issued under any circumstances once payment has been received. •Subjective dissatisfaction, aesthetic disagreement, lighting variation, screen calibration differences, scale perception, or buyer’s remorse do not qualify for refund. •Submission of payment constitutes a binding agreement to purchase. NATURE OF ORIGINAL ARTWORK Original artwork is inherently subjective, expressive, and non-standardized. Variations in color, tone, texture, brushwork, and visual impact may occur due to photography, lighting, screen differences, and the handmade nature of the work. Personal interpretation does not constitute grounds for dispute. NO CHARGEBACKS •Buyer agrees not to initiate chargebacks or payment disputes except in cases of proven fraud. •Improper chargebacks constitute breach of contract and may result in legal action and recovery of costs. ARTIST’S RIGHT TO DOCUMENT The Artist retains the perpetual right to photograph, reproduce, and publicly display the artwork for promotional and archival purposes. LIMITATION OF LIABILITY •To the maximum extent permitted by law, the Artist shall not be liable for indirect, incidental, consequential, punitive, or special damages. •Total cumulative liability shall not exceed the purchase price paid. DISPUTE RESOLUTION These Terms are governed by the laws of the State of Connecticut. Any dispute shall be resolved exclusively through mandatory binding arbitration administered by the American Arbitration Association (AAA) in Fairfield County, Connecticut. Only if arbitration is deemed unenforceable may litigation proceed in Fairfield County courts.
