WORKSHOP TERMS & CONDITIONS Effective February 25, 2026 If you do not agree, do not proceed with registration. IMPORTANT WORKSHOP DISCLOSURE Workshop fees vary based on scope, duration, materials, and customization. A minimum 50% non-refundable payment is required to reserve a workshop. All workshop payments are non-refundable except as expressly stated below. Participation involves inherent minor risks associated with art materials. WORKSHOP FORMAT Workshops are designed for adults unless otherwise specified. If contracted for children, the structure and instruction will be customized according to age group and comfort level. Workshops run a minimum of two (2) hours and may be extended at the instructor’s discretion. PAYMENT & RESERVATION A minimum fifty percent (50%) non-refundable payment is required to reserve a workshop space. Full payment must be completed by the date specified at registration. No booking is confirmed until payment has been received. CANCELLATION & RESCHEDULING (CONNECTICUT COMPLIANCE) If written cancellation notice is received at least fourteen (14) calendar days prior to the workshop date, one rescheduling opportunity of equal value may be granted within ninety (90) days. Fewer than fourteen (14) days’ notice results in forfeiture of payment. Failure to attend without notice forfeits all payments. If the instructor cancels, participants may choose either a full refund or rescheduling. MATERIALS Unless otherwise stated, materials are provided by the Artist. If a supply list is provided, participants are responsible for bringing required items. Failure to bring materials does not qualify for refund or rescheduling. ASSUMPTION OF RISK, RELEASE & HOLD HARMLESS Participation is voluntary. Activities may involve tools, paints, solvents, adhesives, cutting instruments, and other materials carrying inherent risks including cuts, allergic reactions, slips, falls, or property damage. By registering, Participant voluntarily assumes all risks and agrees to release, waive, discharge, indemnify, and hold harmless Lily Fertik from any and all claims, liabilities, damages, costs, or expenses arising from participation, except where liability cannot legally be waived. This applies to private residences, studios, rented venues, and third-party locations. PHOTOGRAPHY & MEDIA RELEASE By attending, Participant grants permission for photography and recording for promotional, archival, and educational purposes. No compensation will be provided. Participants may share photos for personal, non-commercial use and are encouraged to tag @LilyLifeDesigns. Lily Fertik, doing business as Lily Life Designs (“Artist,” “Company”), provides in-person workshops and instructional services. By registering and submitting payment, the Participant affirms that they have read, understood, and accepted these Terms & Conditions in their entirety. Submission of payment constitutes binding contractual acceptance. INTELLECTUAL PROPERTY & AI PROHIBITION All workshop techniques, instructional methods, curriculum designs, and materials are proprietary to the Artist. No participant may record, reproduce, distribute, teach, sell, or commercially exploit workshop content without prior written consent. All Protected Works are expressly excluded from use in Artificial Intelligence (AI), Machine Learning (ML), Neural Networks, or LLM training datasets. No implied license is granted. LIMITATION OF LIABILITY To the maximum extent permitted by law, the Artist shall not be liable for indirect, incidental, consequential, punitive, or special damages arising from workshop participation. Total cumulative liability shall not exceed the workshop fee paid. DISPUTE RESOLUTION These Terms are governed by the laws of the State of Connecticut. Any dispute shall be resolved exclusively through mandatory binding arbitration administered by the American Arbitration Association (AAA) in Fairfield County, Connecticut. Only if arbitration is deemed unenforceable may litigation proceed in Fairfield County courts.
